This writ petition has been filed by the petitioner seeking

direction to the respondents to grant benefit of Old Pension

Scheme to the petitioner instead of new pension scheme with all

consequential benefits.

Learned counsel for the petitioner submits that despite

various representations made by the petitioner in this regard, the

petitioner has not been accorded the relief as claimed by the

petitioner.

Submissions have been made that the plea raised by the

petitioner is squarely covered by the judgment rendered in

Omprakash Beniwal vs. State of Rajasthan & Ors. : S.B. Civil Writ

Petition No.8204/2014 decided on 10.07.2017 and, as such the

petitioner is entitled for the same relief.

In view of submissions made, the writ petition filed by the

petitioner is disposed of; the respondent competent authority is

directed to decide the pending representation made by the

petitioner in the light of judgment in the case of Omprakash

Beniwal (supra) appropriately and expeditiously, preferably within

a period of six weeks from the date the copy of this order is

placed by the petitioner with the respondents.

The petitioner would be at liberty to file fresh detailed

representation, if so advised.
