1. Petitioner has filed this bail application under Section 438 of

Cr.P.C.

2. F.I.R. No.550/2020 was registered at Police Station, Todarai

Singh, District Tonk (Raj.) for offence under Sections 143, 452,

323, 308, 354 and 354-B I.P.C.

3. It is contended by the counsel for the petitioner that there is

cross FIR. Co-accused have been given benefit of bail under

Section 438 and 439 of Cr.P.C. It is also contended that there are

general allegations against the petitioner in the FIR.

4. Learned Public Prosecutor has opposed the bail application. It

is contended that there is specific allegation against the petitioner

of causing injury on the head with an axe. There is also allegation

that they entered the house of the complainant, armed with axe,

rods and swords.

5. I have considered the contentions.

6. Taking note of the fact that there is specific allegation that

the present petitioner caused injury to the injured on the head by

an axe. The injured was initially admitted to Tonk Hospital and

then he was referred to SMS Hospital, Jaipur and considering the

contention put forth by counsel for the State, I am not inclined to

entertain the anticipatory bail application.

7. The Anticipatory Bail Application is dismissed.
