1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.232/2020 was registered at Police Station Kolari,

District Dholpur for offence under Section 363 I.P.C.

3. It is contended by counsel for the petitioner that after

rejection of the first bail, statement of the complainant who is the

father of the deceased has been recorded. He has stated that he

has apprehension that petitioner was involved in the murder of his

child. It is also contended that petitioner is a female and there is

special provision with regard to females under the Code of

Criminal Procedure.

4. Learned Public Prosecutor has opposed the second bail

application. It is contended that the first bail was rejected by this

Court on merits after considering the entire material evidence.

5. I have considered the contentions.

6. From the evidence, it is evident that the child who happens

to be a two year old boy was last seen entering the house of the

petitioner. A knife and a bed sheet have been recovered at her

instance and there were burn abrasion wounds on the body of the

deceased. The first bail was rejected by this Court on merits.

There is no change in circumstance and considering the

contentions put forth by counsel for the State, I am not inclined to

entertain the second bail application.

7. This second bail application is, accordingly, dismissed.
