This application under Section 482 CrPC has been

preferred on behalf of the applicant seeking extension of time to

surrender before the Superintendent, Central Jail, Jodhpur.

Learned counsel for the applicant has submitted that

this Court vide order dated 03.06.2021 has suspended the

sentence of the applicant - Bhawani Singh temporarily for a

period of three months with a direction that he shall surrender

before the Superintendent, Central Jail, Jodhpur on or before 4 th

September, 2021 at 10:00 A.M. positively. It is further submitted

that earlier also the sentence of the applicant was suspended

temporarily on 10.12.2019, 05.03.2020, 12.05.2020 and

19.10.2020 on the ground of his ill-health as he is suffering from

HIV+(AIDS). It is also submitted that the health condition of the

applicant-appellant is very critical, his lungs are damaged and he

is not able to stand on his own feet without any support. It is,

therefore, prayed that six months' time may be granted to the

applicant to surrender before the Superintendent, Central Jail,

Jodhpur.

Having considered the totality of facts and

circumstances of the case, we deem it just and proper to extend

the time to surrender by applicant himself before the

Superintendent, Central Jail, Jodhpur.

Hence, it is ordered that the period to surrender by the

applicant - Bhawani Singh son of Mod Singh is extended for a

period of three months. He shall surrender before the

Superintendent, Central Jail, Jodhpur on or before 26 th November,

2021 at 10:00 A.M. positively.

The application stands disposed of.
