An application has been filed by the appellant for exempting the condition No.4 imposed on the appellant by this Court vide order dated 15.07.2021 while allowing the application for Suspension of Sentence. The condition imposed was that the appellant shall deposit the fine amount as imposed by the trial court.

Counsel for the appellant submits that appellant is a very poor person and belongs to tribal background and in his family there is no sufficient source of income, therefore he is not in a position to deposit the fine amount as imposed by the trial court, therefore condition No.4 imposed by this Court vide order dated 15.07.2021 may be exempted.

Per contra, learned Public Prosecutor opposed the prayer made by the counsel for the appellant.

In view of the submissions made and for reasons stated in the application, I deem it appropriate to waive the condition No.4 imposed in the order dated 15.07.2021.

Accordingly, the condition No.4 imposed in the order dated 15.07.2021 passed in S.B. Cr. Misc. Suspension of Sentence

Application No.274/2021 regarding deposition of fine amount is waived.

The misc. application is allowed accordingly. Now the appellant shall appear before this Court on 27.09.2021 for his attendance.
