Learned counsel for the petitioners has submitted that the

issue regarding Private Educational Institutions to be treated as

'industry' is pending consideration before the Hon'ble Supreme

Court in the appeal preferred by one Private Educational

Institution Bhopalwala Arya Higher Sec. Management Committee,

Sriganganagar and the Hon'ble Superme Court has stayed the

operation of the jugement of the Rajasthan High Court wherein, it

is held that the Private Educational Institutions are 'industry',

however, despite that the respondents have issued a notice

(Annex.-2) directing the petitioners to get themselves registered

under the provisions of Employees State Insurance Act, 1948.

Issue notice. Issue notice of stay petition as well.

In the meanwhile, the respondent-State shall not insist the

petitioner- Institutions to get themselves registered under the

provisions of Employees State Insurance Act, 1948.
