1. It is submitted that the controversy involved in the present

case is squarely covered by the Division Bench judgment of this

Court rendered in the case of State of Rajasthan & Anr. Vs.

The Management Committee Sh. Bhagwan Das Todi

College, reported in 2016(2) WLC (Raj.) 1.

2. In view of the submissions made, issue notice. Issue notice

of stay application also, returnable within four weeks.

3. Notices be given 'dasti' to learned counsel for the petitioner,

if so desired.

4. Meanwhile, if petitioner makes payment of its share as per

rules (10% of the amount), recovery of the amount pursuant to

the impugned order dated 01.02.2021 from petitioner shall remain

stayed.

5. It would be open for respondent No.1 to seek compliance of

rest of the directions against the State.
