                           SANJAY VASHISTH, J.

1. By way of present petition, petitioner seeks grant of

anticipatory bail under Section 482 of BNSS, 2023, in case, bearing FIR

No.174 dated 25.07.2025 registered under Sections 25(8) of Arms Act at

Police Station Lopoke, District Amritsar.

2. On 30.10.2025, following order was passed:-

"The learned counsel for the petitioner contends that the petitioner has been named only in the disclosure statement of the main accused namely Rajwinder Singh S/o Surinder Singh and Joban Singh S/o Gian Singh from whom the weapons were recovered.

Notice of motion for 15.01.2026. Mr. Harkanwar Jeet Singh, Asstt. A.G., Punjab accepts notice on behalf of the respondent-State.

In the meantime, the petitioner is directed to appear before the SHO/Investigating Officer to join investigation and in the event of his arrest, he shall be released on bail on his furnishing bail bonds to the satisfaction of SHO/Investigating Agency subject to the

following conditions as envisaged under Section 482(2) BNSS:-

i) that the petitioner shall make himself available for interrogation before the Investigating Officer as and when required;

ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer;

iii) that the petitioner shall not leave the country, without prior permission of the Court and shall surrender his/her/their passport, if any.

Meanwhile, the State counsel is directed to file an affidavit as to the exact role of the petitioner along with the details of pending FIRs, if any, on or before the next date of hearing."

3. Continuing his submissions, learned counsel for the

petitioner contends that in compliance of the order dated 30.10.2025,

passed by this Court, petitioner has joined the investigation, and has fully

co-operated. Therefore, he prays for confirmation of the said interim

anticipatory bail order.

4. On the other hand, learned State counsel has filed status

report dated 18.03.2026 in the Court today and the same is taken on

record.

Learned State counsel on instructions, confirms the said

averment made by counsel for the petitioner of joining the investigation

on 20.11.2025 by the petitioner, and submits that as of now, custodial

interrogation of the petitioner is not required for the purpose of

investigation.

5. Heard learned counsel for the parties.

6. Since, petitioner has already joined the investigation and

custodial interrogation is no more required; ad-interim bail order dated

30.10.2025, passed by this Court is hereby made absolute. Accordingly,

present petition is allowed.

However, petitioner shall continue to join the investigation

as and when required to do so and abide by all the terms and conditions

laid down under Section 482(2) of BNSS, 2023.

7. Accordingly, petition stands disposed of.

However, present order would be subject to the submission

of passport of the petitioner to the Investigating Agency or to Court

concerned, if he possesses, within a period of one week from today.

Otherwise, he would submit an affidavit, disclosing the fact that he does

not possess any passport.

It is clarified that in case, aforesaid condition is not complied

with, this order would be considered as non est automatically.
