1. The instant petition has been filed under Section 483 of the
Bharatiya Nagarik Suraksha Sanhita, 2023, for the grant of regular bail in
case bearing FIR No. 36 dated 24.10.2024, registered under Section(s) 419,
420, 465, 467, 468, 471 and 120-B of the Indian Penal Code, 1860 at Police
Station Punjab State Crime Police Station, District S.A.S. Nagar, Mohali.
2. Briefly summarized the facts of the present case are as follows:-
"Tersely, FIR in the present case was registered consequent to
the complaint filed by Hardial Kaur widow of Rajinder Singh
before the office of Director, Bureau of Investigation, Punjab,
Chandigarh for taking appropriate action by registering a
criminal case under Section 199, 319, 336 (2) (3) (4), 338, 340
(2), 61 (2), 111 BNS, 2023, against Hardial Kaur daughter of
Balbir Singh son of Tara Singh, Parampal Singh son of Balbir
Singh son of Tara Singh, Balveer Singh son of Darshan Singh,
Navjinder Singh son of Safdarpal Singh, Safdarpal Singh son of
Ranbir Singh, Ranjeet Singh Tehsildar Jaitu, Additional Charge
Sadiq and Gurdeep Singh Reader Tehsildar Sadiq, who in
collusion with each other, after getting the details of the land of
the complainant from a lady namely accused Hardial Kaur wife
of Rajinder Singh, daughter of Balbir Singh son of Tara Singh,
prepared a fake General power of attorney dated 20.05.2024 in
favour of her brother Parampal Singh, who in collusion with
the Reader Gurdeep Singh and Tehsildar Ranjit Singh, by using
the same got registered the sale deeds of the land of the
complainant situated at Village Gujjar, Tehsil Sadiq District
Ferozepur, in favour of Balvir Singh, Navjinder Singh and
Safdarpal. Complainant in her complaint submitted that she is
an 80 year old widow and her husband Rajinder Singh had died
on 01.04.2022 and her son Jaspal Singh had also died on
18.02.2017. She stated that she has two brothers namely
Gurdeep Singh and Prem Singh, who also died 10 years and 40
years ago respectively. She owns a land at Village Mumara,
District Faridkot. Besides, that after the death of her son Jaspal
Singh, his land situated at village Gujjar was transferred in her
name and her husband had executed a registered Will dated
01.10.2019 in her favour. The above said persons in collusion
with each other and as her name is similar to Hardial Kaur
daughter of Balbir Singh son of Tara Singh, wife of Rajinder
Singh, with an intention to commit cheating with her, got
registered a General Power of attorney dated 20.05.2024 of
accused Hardial Kaur in favour of Parampal Singh son of
Balbir Singh vide deed no.2024-2025/116/4/53 before Sub-
Registrar, Ferozpur, in which they in collusion with each other
got mentioned the details of the land under the ownership of the
complainant with an intent to commit cheating and gave the
rights to sell the said land to Parampal Singh son of Balbir
Singh, Vijay Kumar Nambardar Village Sandwan and Davinder
Singh son of Pritpal Singh resident of Araiyan Wala Khurd,
District Faridkot, who were from outside Village Gujjar put
their testimony on this fake General Power of Attorney and
verified Hardial Kaur daughter of Balbir Singh. Upon enquiry
by the complainant, she came to know that accused Hardial
Kaur daughter of Balbir Singh has no land in village Gujjar
and above said GPA has been prepared under a pre-planned
conspiracy for committing cheating. On this GPA, Hardial
Kaur has put signatures in Punjabi, whereas, complainant has
never signed any document in Punjabi and she always signed in
English. Complainant further submitted that after execution of
GPA in favour of Parampal Singh, he got registered sale deeds
of his land situated in Village Gujjar in favour of Navjinder
Singh, Safdarpal Singh and Balbir Singh, being in collusion
with them vide deeds dated 24.07.2024. Complainant further
asserted that she has come to know that in lieu of sale deeds, no
amount has been transferred in accounts of Hardial Kaur and
Parampal Singh. Rather, this is an organized gang, which
prepares fake documents of land of helpless people and grab
their property. Complainant further stated that Safdarpal Singh
and Navjinder Singh know her very well being residents of
Village Gujjar. Besides, that her civil suit titled as Harjinder
Singh etc. Vs. Harpal Singh etc. is going on against above said
Safdarpal Singh etc. and in the said case, both the parties
appeared in the Ld. court. As such, aforesaid Safdarpal Singh
and Navjinder Singh are well aware about her tough
circumstances. Complainant further rued that besides this, a
case bearing FIR No.56 dated 08.08.2019 under Sections 406,
120-B IPC was got registered against Safdarpal Singh and
Navjinder Singh in PS Sadiq by Simarjit Singh son of Gurmukh
Singh resident of Sirsa, Haryana. Complainant further averred
that Parampal Singh son of Balbir Singh earlier also had sold
the land of Sukhdev Singh son of Mukhtiar Singh resident of
village Dulo Wal, Tehsil Mansa to Khushwant Singh Brar son
of Beant Singh vide sale deed by preparing his fake GPA, in
which he mentioned his address only Village Deepsingh Wala
but the GPA which has been prepared for selling her land, the
address of Parampal Singh in it is 2/65, Kasuri Gate, Ferozpur
City, presently resident of Village Deepsingh Wala, District
Faridkot (the detail of 2/65, Kasuri Gate, Ferozpur City) has
been given only to show Hardial Kaur as his sister and an
inquiry in this regard is going on separately. Complainant also
added that Safdarpal Singh etc. want to grab her land and land
of her family by preparing fake documents. In this regard, she
went to Sadiq on 03.7.2024 and after meeting Tehsildar
Baljinder Singh she brought the matter to his notice, who
assured her that if any sale deed of her land will be received for
registration, their office will contact her. Tehsildar Baljinder
Singh went on leave for one month on 18.07.2024 and in his
place, Tehsildar (Jaitu) Ranjit Singh was given additional
charge of Sadiq. When she came to know, she arrived at
Faridkot on 24.07.2024 and sent a written application to
Tehsildar Sadiq in Sadiq Tehsil through Satnam Singh son of
Balbir Singh resident of Churar Khalchian District Ferozpur,
(who is her commission agent). After reaching Sadiq, Satnam
Singh made a phone call to her at about 02:30-03:00 PM that
Gurdeep Singh (Reader to Tehsildar) had received the
application but he was not issuing the receipt and asking to
send it instead by speed post. At this, Satnam Singh came back
and as per the asking of Gurdeep Singh, Reader, he sent the
application regarding non-registration of sale deed to Tehsildar
Sadiq, SDM Faridkot, District Magistrate Faridkot through
speed post from Post-Office Faridkot. But later on, she came to
know that non-issuance of receipt of application by Gurdeep
Singh was part of pre-planned conspiracy because Tehsildar
Ranjit Singh, despite knowing that sale deed of her land was
wrong, he registered the same at about 08:00/08:30PM.
Therefore, it was requested that above cited persons are
members of an organized criminal gang, who produced accused
Hardial Kaur and got provided the details of land under the
ownership of complainant and prepared fake GPA in the name
of Parampal Singh, who by using the same, got registered six
sale deeds of her land situated in village Gujjar without any
monetary transactions, in favour of their accomplices Balbir
Singh, Navjinder Singh and Safdarpal Singh being in collusion
with reader Gurjeet Singh and Tehsildar Ranjit Singh, while
violating the law."
3. Learned Counsel appearing on behalf of the petitioner contends
that the petitioner had earlier approached this Court for seeking anticipatory
bail vide CRM-M-4459-2025. An interim order was passed on 27.01.2025,
however, eventually, the petition was dismissed vide order dated
09.02.2026. He contends that thereafter the petitioner was taken in custody.
It is submitted that the petitioner is an attesting witness to the General Power
of Attorney which has been allegedly forged. He submits that the beneficiary
of the GPA namely Parampal Singh son of Balvir Singh and the other
attesting witness i.e. Vijay Kumar (Nambardar) have already been granted
concession of regular bail vide order dated 10.12.2025 passed in CRM-M-
43961-2025 titled as "Parampal Singh versus State of Punjab" and vide
order dated 15.07.2025 passed in CRM-M-13172 of 2025 titled "Vijay
Kumar @ Vijay Pal Kumar versus State of Punjab". He contends that the
case of the petitioner would be at par with the other attesting witness.
4. Learned State Counsel, on the other hand, contends that the
petitioner has one other case against him where he impersonated as one
Sukhdev Singh. She, however, does not dispute that identically placed co-
accused and an attesting witness namely Vijay Kumar, has already been
granted concession of regular bail by this Court.
5. Having heard learned counsel appearing on behalf of the
respective parties and taking into consideration that no recovery is to be
effected from the petitioner and the fact that the case is hand is triable by
Magistrate, I deem it appropriate to enlarge the petitioner on regular bail to
the satisfaction of the trial Court.
6. The instant petition is allowed and the petitioner is ordered to
be released on regular bail on his furnishing requisite bail bond/surety bond
to the satisfaction of the trial Court/Duty Magistrate, concerned.
7. It is made clear that the petitioner shall not extend any threat
and shall not influence any prosecution witnesses in any manner directly or
indirectly.
8. The observation made hereinabove shall not be construed as an
expression on the merits of the case and the Trial Court shall decide the case
on the basis of available material.
