1. The appellant who claims to be physically handicapped and

serving the State of Haryana as a Punjabi Teacher had petitioned this Court

seeking therein issuance of directions to the State to take departmental action

against respondents No.4 to 6 who according to him were harassing him by

forcing him to teach the subject of mathematics to students of Classes 6 to 8.

2. Through the impugned judgment the learned Single Judge

dismissed the appellant's petition on the ground that there was no rule or

provision in law which would entitle the appellant to seek the prayer made

by him.

3. Learned counsel for the parties have been heard.

4. At the outset, learned State counsel informs this Court that on

the complaint made by the appellant an inquiry report dated 20.09.2023 had

been forwarded by the District Elementary Education Officer, Kaithal to the

Director, Elementary Education, Haryana at Panchkula (for short - the

Director). Acting on such report a Committee has been formed by the

Director which has already deliberated into the matter and is shortly

expected to give its final report.

5. In the light of the afore stand taken by the State, after setting

aside the impugned judgment, we dispose of the instant appeal with a

direction to the State to take, within one month from today, a final decision

on the aforesaid report dated 20.09.2023 forwarded to the Director by the

District Elementary Education Officer, Kaithal.
