1. Learned counsel for the petitioners submits that the question of law

raised in the present petition, has already been decided by this Court while

passing order in CWP No.7242 of 2023, titled Naresh Kumar Goel and

others v. State of Punjab and others, decided on 17.09.2024 hence, the

present petition be also disposed of in the same terms.

2. Notice of motion.

3. On the asking of the Court, Mr.Arun Gupta, DAG, Punjab., who is

present in Court, accepts notice on behalf of respondent - State.

4. Learned counsel for the State does not dispute the same but

submits that the State intends to avail appropriate remedy against the said order.

5. Keeping in view the fact that the respondents have not disputed

that the question of law raised in the present petition has already been decided

by this Court while passing order in Naresh Kumar Goel's case (supra),

decided on 17.09.2024 and the only contention is that the State intends to avail

the appropriate remedy against the said judgment, the relief cannot be denied to

the petitioner only on the ground that department is availing the remedy against

the order which is being relied upon.

6. Present petition is also disposed of in terms of Naresh Kumar

Goel's case (supra).
