The present application has been preferred under Section 378(4) Cr.P.C. for grant of Special Leave to Appeal against the judgment of acquittal dated 02.08.2018 passed by JMIC, Malerkotla.
On the last date of hearing, there was no representation on behalf of the applicant/appellant and on the first date of hearing i.e. 26.11.2018, the matter was adjourned on the request of learned counsel for the applicant/appellant alone as is evident from order sheets.
It is also abundantly clear from the case file that notice of motion was not yet issued in the application for Special Leave to Appeal under Section 378(4) Cr.P.C.
Today also, none has appeared on behalf of the applicant/appellant in Court to assist in the matter.
In the light of consistent non-appearance on behalf of the applicant/appellant, I am fully convinced that the applicant/appellant is not interested in pursuing the present case any further.
Hence, the same is dismissed for non-prosecution.
