The present petition has been filed by the petitioners under

Articles 226/227 of the Constitution of India, seeking a writ of

mandamus, directing the respondents to release the pensionary benefits

of the petitioner in accordance with the length of service of the

petitioners and arrears of pension @ 24% per annum.

On the last date of hearing i.e. 06.08.2024, the following

order was passed:-

"The present petition was admitted on 06.08.2001 and now it has been listed for final disposal.

Learned counsel for the respondents submits that the present case is squarely covered by the judgment of Hon'ble Supreme Court passed in Pepsu Road Transport Corporation, Patiala Vs. Mangal Singh and others :

2011(11) SCC 702 against the petitioners. He further submits that both the petitioners have already been paid all the benefits under the C.P.F. Scheme.

Since there is no representation on behalf of the petitioners, let notice be issued to the petitioners and Sh. D.K. Kaushal, Advocate, counsel for the petitioners, returnable on 05.09.2024."

Learned counsel for the respondents submits that besides

the judgment passed by the Hon'ble Supreme Court in "Pepsu Road

Transport Corporation, Patiala Vs. Mangal Singh and others",

2011(11) SCC 702, the case of the petitioners is also covered by another

judgment of Hon'ble Supreme Court in "Pepsu Road Transport

Corporation, Patiala vs Amandeep Singh and others", 2017(1) SCT

432.

The said legal position has not been disputed by learned

counsel for the petitioners.

In this view of the matter, the present petition is dismissed

in terms of the judgment passed by the Hon'ble Supreme Court in

Pepsu Road Transport Corporation, Patiala's case (supra) and

Amandeep Singh's case (supra).
