1. On the last date of hearing, following order was passed:-

"As per report of the Registry, respondent No.2 could not be served for want of correct address.

Given above, correct address of respondent No.2 be filed by 18.10.2024 failing which the Registry to list this ma er on 23.10.2024 on which date the present pe on shall be dismissed for non-prosecu on.

However, on filing of correct address by the pe oner, fresh no ce be issued to respondent No.2 for 17.01.2025."

2. Today, counsel for the pe oner has expressed his inability to furnish correct address of respondent No.2. Counsel submits that her husband i.e. respondent No.2 is one of the party in Regular Second Appeal but they had no contact.

3. Be that as it may, previous order is not complied with.

4. Given above, the present pe on is dismissed for non-prosecu on with liberty to file fresh on being aware of the correct address of respondent No.2.

5. It is clarified that the me for which the pe on was pending before this Court shall not be counted for the purpose of limita on and further pe oner shall be permi ed to seek condona on of delay on the ground of non-availability of correct
