The petition has been filed, inter alia, seeking a writ of mandamus

directing the respondents to promote the petitioner to the post of Head Master

of High School with effect from the date his juniors have been promoted vide

order dated 12.08.2021, Annexure P-1, by correcting his seniority number in

the seniority list 2016 of ESHM.

2. At this stage, on oral request made by learned counsel for the

petitioner, Director Elementary Education, Haryana, is ordered to be impleaded

as respondent no.4 to the petition. Registry is directed to make necessary

correction in the memo of parties.

3. Learned counsel for the petitioner submits that grievance raised

herein is pending for appropriate decision before the respondents. At this stage,

the petitioner will be satisfied in case respondent No.4 is directed to decide the

pending representation, dated 15.02.2023, Annexure P-3, in a specified period.

4. Ms. Tanushree Gupta, DAG, Haryana, accepts notice on behalf of

the respondents/State and submits that the pending representation, dated

15.02.2023, will be decided by the fourth respondent-Director Elementary

Education, by passing a speaking/reasoned order in accordance with law within

a period of three months.

5. In view of the statement made, learned counsel for the petitioner

has no objection to the petition being disposed of in terms thereof.

6. Ordered accordingly.
