1. Seeking issuance of necessary direc ons to the respondents No.1 and 2 to consider and to decide the parole case of the pe oner pending since 15.01.2024 and grant 10 weeks regular parole to the pe oner under the provisions of Sec on 3 of The Haryana Good Conduct Prisoner's (Temporary Release) Act, 2022, the pe oner has come up before this Court under Ar cle 226 of Cons tu on of India.
2. Counsel for the pe oner submits that the pe oner had applied for parole on 15.01.2024 for 10 weeks and the authority is si ng over the ma er from the last nine months and no ac on is being taken.
3. On the other hand, the ground taken by the State counsel was that due to imposi on of Model Code of Conduct because of ongoing assembly elec on, the decision could not be taken. Now the elec ons are over and new government has come in place and they will take a decision on the pe on of the pe oner without any delay.
4. Given the rival submission of both the par es, let respondent No.3 take decision on the applica on of the pe oner for grant of parole by 08.11.2024 and refer the ma er for perusal of respondent No.2 and also communicate the outcome of decision to the pe oner's family without any delay. The present pe on is disposed of with the aforesaid observa ons. All pending applica ons, if any also stands disposed.
