1. On 31.01.2024 fresh notices were issued to the appellants as the

counsel appearing on behalf of the appellants had pleaded no instructions in

the matter. Today also learned counsel appearing on behalf of the appellants

pleads no instructions. As per the office report, appellant No.1 stands duly

served. Appellant No.2 is stated to have gone to Canada and appellant No.3

is stated to have gone to Australia. No other address of the appellant Nos.2

and 3 is available except for the one as mentioned in the memo of parties as

well as in the judgments of the Courts. None has put in appearance on behalf

of appellant No.1 despite service.

2. In view of the above, this Court is left with no other option but

to dismiss the present appeal for non-prosecution.
