Learned counsel for the appellant submits that it is not known whether the respondent-plaintiff is alive or not.

Learned counsel for the appellant further submits that judgment and decree of the Courts below under challenge in the present regular second appeal have already been stayed by this Court hence, the present regular second appeal may kindly be disposed of having been not pressed any further with liberty to revive the same in case, any effort is made by the respondent-plaintiff or his legal heirs to get the judgment and decree of the Courts below executed.

Ordered accordingly.

Executing Court is also directed that without there being any direction from this Court, judgment and decree of the Courts below be not executed.

Civil miscellaneous application pending, if any, is also disposed of.
