1. The appellant/defendant No.3 has filed the instant appeal

against judgment and decree dated 09.04.1991 passed by learned Sub

Judge Ist Class, Chandigarh, whereby a suit for declaration filed by

respondent No.1/plaintiff has been decreed and judgment and decree

dated 10.09.1996 passed by learned Additional District Judge,

Chandigarh, whereby an appeal filed by the defendants (including the

appellant) against the judgment and decree dated 09.04.1991 has been

dismissed.

2. On the last date of hearing, it was submitted by learned

counsel for the appellant that respondent No.1 has already retired, on

attaining the age of superannuation, on 31.10.2018 as UDC/SSA and

learned counsel for respondent No.1 had sought time to get instructions

from respondent No.1.

3. Learned counsel for respondent No.1 submits that despite

his best efforts, he has not been able to get instructions from respondent

No.1.

4. In this view of the matter, the instant appeal has been

rendered infructuous as respondent No.1/plaintiff has already stood

retired from service, on attaining the age of superannuation, on

31.10.2018 and the claim of respondent No.1/plaintiff before the Courts

below was for regularization of his services and against his reversion.

5. Disposed of as having become infructuous.

6. Pending application, if any, shall stands disposed of

accordingly
