1. This is a contempt petition filed under Section 11 read with
Section 12 of the Contempt of Courts Act, for initiating contempt
proceedings against the respondents for non-compliance of the order dated
29.04.2023 passed in RSA-1362-2021.
2. A perusal of the case file shows that Regular Second Appeal
filed by the petitioner has been allowed resulting into determining the rights
and liabilities of the parties. The petitioner is having an alternate remedy of
getting the judgment/order of the Appellate Court executed. Therefore, it
would not be appropriate to interfere in the matter by way of contempt
petition.
3. Dismissed.
4. However, the petitioner would be at liberty to avail his alternate
remedy, but in accordance with law.
