1. Though the present IOIN was listed for service of the

respondents, yet vide order dated 08.11.2023 notices to the parties for actual

date of hearing of the main appeal stand issued and as such the present IOIN

is disposed off as having become redundant.

2. As per the office report, appellant Nos.1 to 3 remain unserved

as they were not found residing at the given addresses. Appellant No.4 is

stated to have died. Respondent Nos.1(i) to 1(iv) and 2 remain unserved with

the report that no such village exists in Ferozepur. Notices issued to

respondent Nos.7 to 14 have been given to the Sarpanch of the concerned

integrity of this order/judgment.

village. No one has come forward to get themselves impleaded as legal

representatives of appellant No.4 nor any counsel has put in appearance on

their behalf. This is the only address of appellant Nos.1 to 3 which was

given in the memo of parties as well as in the judgments and decrees of both

the Courts. In view thereof, this Court is left with no other option but to

dismiss the present appeal for non-prosecution.

3. Dismissed for non-prosecution with liberty to revive in case

anything survives in the matter. Pending applications, if any, also stand

disposed off.
