1. The present IOIN was for service of the respondents. However,

vide order dated 17.11.2023, notice for actual date of hearing in the main

appeal was ordered to be issued to the appellant and respondents for today

and accordingly the present IOIN being infructuous, is disposed off as such.

2. The present appeal pertains to the year 1997. Vide order dated

17.11.2023 notices were issued to the parties. As per the service report, sole

appellant was not found residing at the given address. This is the only

address of the appellant which was given in the memo of parties and in the

judgments and decrees passed by the Trial Court and the First Appellate

Court. Respondent No.1 remains unserved as no such firm exists.

Respondents No.2 and 5 stand duly served. Though Mr. Akshat Mittal,

Advocate has appeared for Sh. Rajinder Goel, Advocate, yet he pleads no

instructions on behalf of the appellant. In view thereof, this Court is left with

no other option but to dismiss the present appeal for non-prosecution.

3. Dismissed for non-prosecution with liberty to revive in case

anything survives in the matter. Pending applications, if any, also stand

disposed off.
