1. The petitioner was tried for an offence under Section 138 of

Negotiable Instruments Act (for brevity, NI Act) vide Crl. Complaint No.

396 of 2016, titled as Satish Kumar Vs. Sunil Kumar and was convicted and

sentenced to imprisonment and to pay compensation under Section 138 NI

Act vide judgment and order dated 13/16.04.2018 by the Court of Judicial

Magistrate Ist Class, Sonepat. The petitioner preferred an appeal against the

said judgment and order, wherein he got absented and declared proclaimed

person vide order dated 06.04.2022 (Annexure P-3) and his appeal was

dismissed in absentia vide judgment of even date (Annexure P-6). FIR No.

233 dated 11.04.2022 (Annexure P-5) was also registered at Police Station

Sonepat City, under Section 174-A IPC against the petitioner. The petitioner

has challenged order dated 06.04.2022 and consequent FIR (Annexure P-5).

3. The present petition is hereby disposed of with direction to the

petitioner to surrender before the Court concerned within next 15 days and

then to move an application seeking grant of regular bail, which is to be

disposed of by Court concerned in accordance with law. In case the

petitioner fails to surrender within the given period, then the present petition

will be deemed to have been dismissed.
