1. The present appeal has been filed by the appellant against the

judgment and decree dated 03.09.1991 passed by the District Judge,

Bathinda, in Civil Appeal No.90 dated 06.12.1989 whereby the appeal

against the judgment and decree dated 02.11.1989 passed by the Sub-Judge

1st Class, Phul, had been set aside.

2. The appeal was admitted in the year 1992 and notice to both the

parties was again directed to be issued for 22.07.2019 vide order dated

29.03.2019. It has been reported by the Registry that the sole appellant has

expired and even respondent No. 2 is currently indispose.

3. Fresh notice was directed to be issued vide order dated

06.12.2022. The report has been received yet again that appellant has since

passed away. There is no representation on behalf of the appellant and as per

the office report, efforts were made to trace out the counsel representing the

appellant and it has been reported that he is also not traceable.

4. On the asking of this Court, Mr. Saurav Verma, Advocate, who

is on the panel of respondent-Bank is directed to and accepts notice on

behalf of respondent No.1-PNB being standing counsel of PNB.

5. The present appeal is accordingly Dismissed in Default.

6. Liberty is however granted to the LRs of the appellant to seek

revival of the instant appeal.
