By filing the instant revision-petition, the petitioner/Judgment-

Debtor No.2 (here-in-after to be referred as 'JD No.2') has laid challenge to

the order passed by learned Civil Judge (Junior Division), Hoshiarpur (for

short 'the Executing Court') on 16.11.2023 in Execution Petition No.73 of

2022 titled as "Vikram Singh Walia Vs. Shakuntala Devi and another",

whereby the objection-petition, as preferred by him, has been dismissed.

2. However, at this stage, learned counsel for the petitioner-JD

No.2 submits that his client has already moved an application under Order

9 Rule 13 CPC and the same is pending before the Court below and he (JD

No.2) has also moved an application therein with the prayer to stay the

execution proceedings and he (learned counsel) restricts his prayer to the

issuance of direction to the above-said Court to decide the afore-referred

stay application expeditiously.

4. Keeping in view the above-discussed limited prayer as made

by learned counsel for the petitioner-JD No.2 and without commenting or

expressing any opinion on the merits of the afore-said Execution Petition or

the application filed under Order 9 Rule 13 CPC or the stay application as

moved therein, the revision-petition in hand is, hereby, disposed of with a

direction to the concerned Court below to decide the above-mentioned stay

application, as expeditiously as possible.
