1. Application for condonation of 3 days in filing the appeal is allowed,

in view of averments made in the application duly supported by affidavit of the

appellant.

2. Delay condoned.

3. CM stands disposed of.

4. The present letters patent appeal has been filed against an order dated

29.01.2024 passed by the learned Single Judge in CWP-1739-2024, whereby the

writ petition was admitted.

5. In our considered opinion, the present appeal is misconceived. The

learned Single Judge has admitted the writ petition for consideration filed by the

writ petitioner-appellant finding merit in the same. In such circumstances, the

present appellant can have no quarrel with the order of admission and the order of

admission itself shows that the writ petition is to be heard within a period of one

year. The ink has not dried on the order and the appeal has been filed.

6. Keeping in view the above and the judgment of the Apex Court in

Midnapore Peoples Co-op. Bank Ltd. vs. Chunilal Nanda and others, (2006) 5

SCC 399, we are of the considered opinion that the appeal is not maintainable and

the same is liable to be dismissed.

7. Ordered accordingly.
