1. Since none had been appearing on behalf of the parties, vide

order dated 05.12.2023 notices were issued to them. As per office report, the

appellant has since expired, however, none has put in appearance on behalf

of legal representatives of the appellant. The respondent stands duly served,

however, none has put in appearance on behalf of the respondent.

2. In view of the above, this Court is left with no other option but

to dismiss the present appeal for non-prosecution.

3. Dismissed for non-prosecution with liberty to revive in case

anything survives in the matter. Pending applications, if any, also stand

disposed off.
