1. The petitioner herein is an employee, whose services were

dispensed with. The High Court ordered his reinstatement. Some other

benefits were also granted by the Hon'ble Supreme Court. Now, the dispute

is with regard to the payment of consequential benefits.

2. On one hand, the petitioner claims that he has not been paid the

consequential benefits, whereas, it is the case of the State that the petitioner

has already been paid as per his entitlement. In the Executing Court, the

petitioner filed an application for directing the respondent to furnish the

details of benefits released to him, which has been dismissed by the

Executing Court.

3. The learned counsel representing the petitioner submits that

some arrears are still due.

4. Be that as it may.

5. It is for the petitioner to prove that he is entitled to some other

benefits. The petitioner after having received huge amount of more than

Rs.9,00,000/- after the judgment of the Hon'ble Supreme Court cannot shift

burden on the respondent.

6. Keeping in view the aforesaid facts, no ground to interfere is

made out.

7. Dismissed accordingly.

8. All the pending miscellaneous applications, if any, are also

disposed of.
