1. The appellant-State has filed the instant appeal against judgment and decree dated 28.11.1997 passed by learned Sub Judge Ist Class, Chandigarh, whereby a suit for declaration filed by the respondent/plaintiff was decreed and judgment and decree dated 03.08.1999 passed by learned Additional District Judge, Chandigarh, whereby the appeal filed by the appellant/defendant against judgment and decree dated 28.11.1997 was dismissed.

2. Learned State counsel, on instructions from Ranjodh Singh, Superintendent Grade-I, Office of Director Horticulture, Punjab, submits that during the pendency of the present appeal, the plaintiff/respondent has unfortunately died on 08.02.2003, however, his LRs have not been brought on record. He submits that he does not want to press the present appeal at this stage with liberty to revive the same in

case any execution is filed by the LRs of the plaintiff/respondent

3. Dismissed as not pressed with liberty as aforesaid.
