1. Plaintiff-appellant filed a civil suit for rendition of accounts and

cancellation of partnership. By judgment and decree dated 16.09.1988, Trial

Court found that the plaintiff is entitled to recover Rs.3002.50/- from the

respondent. Both the parties filed separate appeals before the First Appellate

Court. Learned Additional District Judge, Patiala accepted the appeal filed by

the defendant-respondent and dismissed the appeal, preferred by plaintiff-

appellant, who is before this Court in the instant second appeal.

2. Record shows that the appellant has expired. Despite repeated

opportunities sought by the counsel for the appellant, legal representatives have

not been brought on record. It appears that they are not interested in pursuing the

appeal.

3. Dismissed for non-prosecution.

4. However, liberty is granted to the LRs to file an application for

revival, in case, anything still survives.
