1. The present petition is under Section 439 of Cr.P.C. for grant

of anticipatory bail to the petitioner in FIR No.0093 dated 23.06.2021 under Sections 22, 25, 61 and 85 of the NDPS Act, registered at Police Station Dakha, Ludhiana Rural, Ludhiana, Punjab.

2. Learned counsel for the petitioner submits that the petitioner was granted the concession of regular bail in the said FIR on 10.09.2021 and had been attending the proceedings continuously thereafter. However, on 04.10.2023, he absented himself on account of noting a wrong date which was noted by him as 10.04.2024. Subsequently vide order dated 15.11.2023, the bail bonds were cancelled and the surety was forfeited and non-bailable warrants were issued against the petitioner on 15.11.2023. It

was only thereafter that the petitioner came to know about the said

proceedings and has approached this Court.

3. At this stage, issuance of notice or seeking a reply from State would only procrastinate the proceedings which is not in the interest of justice.

4. Per contra, learned State counsel submits that the petitioner willfully absented himself from the proceedings and in fact there is one more case under the NDPS Act which was lodged in the year 2019 against the petitoiner.

5. After hearing the arguments of the learned counsel for the parties and the fact that the next date of hearing before the trial Court is 03.02.2024, the petitioner is directed to surrender before the concerned Court within one week from today which shall release him on his furnishing of fresh bail bonds and a heavy surety and also the trial Court is directed to proceed in the trial in accordance with law.

6. In light of the above, the present petition is disposed of.

7. It is made clear that, in case, the petitioner is found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the

circumstances and violation of the condition(s) of bail.
