The present regular second appeal has been filed by the plaintiff- appellant against the dismissal of civil suit No.249 of 1987 instituted on 28.04.1987 vide judgment and decree dated 24.05.1990 passed by the Sub Judge First Class, Fatehabad as well as against the subsequent dismissal of Civil Appeal No.37 of 1990 by the Additional District Judge, Hisar vide judgment and decree dated 08.01.1993.

As per office report, respondent is reported to have died. Learned counsel appearing for the appellant submits that he made every possible attempt to contact the appellant, however, no further instructions are forthcoming. He, therefore, pleads lack of instructions.

Dismissed for want of prosecution.

Pending, misc. application(s), if any shall also stand(s) disposed of accordingly.
