1. The present revision petition has been filed by the petitioner-

tenant challenging the order dated 01.03.2024 whereby the defence of the

petitioner-tenant has been struck off.

2. Learned counsel for the petitioner-tenant would contend that

given one opportunity the petitioner-tenant would file his reply and is also

willing to compensate the respondent-landlord by way of costs.

3. Mr. Mrinal Dewan, Advocate assisting counsel of Mr. Gaurav

Pathania, Advocate has put in appearance on behalf of the respondent-

landlord and has filed the power of attorney, which is taken on record.

Learned counsel for the respondent-landlord states that he has no objection if

an opportunity is granted to the petitioner-tenant to file his reply however, he

states that the petitioner-tenant should not delay the proceedings any further.

4. In view of the limited prayer made by learned counsel for the

petitioner-tenant and the stand taken by learned counsel for the respondent-

landlord, the petitioner-tenant is granted one opportunity to file his written

statement on or before the next date of hearing i.e. 14.05.2024 subject to

payment of Rs.10,000/- as costs to be paid to the respondent-landlord, which

shall be a condition precedent. The Rent Controller shall not grant any

unnecessary adjournments in the present case.

5. Disposed off in the above terms. Pending applications, if any,

also stand disposed off.
