1. The present petition pertains to the year 1990. Vide order dated

03.05.2023 notices were issued to the parties. As per the Office report, the

sole petitioner and respondents No.1, 2, 5, 6, 7, 8, 10, 11(a), 14(c), 14(d) and

18 have since died. Respondents No.9, 11(b), 11(c), 13, 14(b), 15 and 16

stand duly served. Respondents No.3 and 14(a) were not found residing at

the given address. Respondent No.4 refused to accept the notice and

accordingly affixation was made. Qua respondents No.12 and 17, who are

minors, it has been reported that their father has since expired.

2. On the previous date of hearing i.e. 14.11.2023 learned counsel

for the petitioner had stated that he had inherited the brief from previous

counsel and had not been able to establish contact with the legal heirs of the

deceased petitioner. He, however, sought time to try and contact the legal

heirs of the deceased petitioner. Today neither anyone has appeared on

behalf of the deceased petitioner nor has any application been filed for

impleading his legal heirs.

3. In view thereof, this Court is left with no other option but to

dismiss the present petition for non-prosecution.

4. Dismissed for non-prosecution with liberty to revive in case

anything survives in the matter. Pending applications, if any, also stand

disposed off.
