VINOD S. BHARDWAJ, J. (ORAL)

The present appeal arises from a civil suit for recovery, which was decreed in favour of the respondent-plaintiff (the Bank) vide judgment and decree dated 08.01.1992 passed by Sub Judge Ist Class, Jalandhar. The appeal preferred against the said judgment and decree has also been dismissed vide judgment and decree dated 30.03.1993 passed by the then Addl. District Judge, Jalandhar.

Notices were issued to the appellants informing them about the listing of present appeal, which have been received back served through the Manager of the Complex. However, no one has chosen to enter appearance on behalf of the appellants.

Perusal of record further shows that initially an interim order was granted in favour of the appellant, which was later on vacated vide order dated 06.03.1995 passed by this Court. It is highly unlikely that the decree in question would not have been executed or satisfied so far. It seems that the appellants have no subsisting interest, as of now.

Dismissed for non prosecution.
