Learned counsel for the appellant-State submits that operation

of the judgment and decree of the Court below was stayed by this Court

vide order dated 15.10.1996 and it is not known whether the respondent is

still alive to claim the benefit of the said judgment and decree of the Court

below hence, the present regular second appeal may kindly be disposed of

having been not pressed any further with liberty to revive the same in case,

any execution petition is filed against the judgment and decree of the Court

below under challenge by the respondent or his legal heirs.

Ordered accordingly.
