1. The present petition has been filed under Section 482 Cr.P.C.

for issuance of appropriate directions to the official respondents to

investigate the entire matter thoroughly and impartially pertaining to the

FIR No. 376 dated 23.09.2023 under Sections 279, 304-A IPC, registered at

Police Station Sohana District SAS Nagar (Mohali) Punjab (Annexure P-1).

2. Learned counsel for the petitioner has vehemently argued and

demonstrates that there are cogent evidence and the investigation needs to

be looked into from the other aspects also, but, has fairly

submitted that he may be permitted to withdraw the present petition, so as

to enable him to avail appropriate remedies under Section 156 (3) Cr.P.C.

however, prays that a direction be issued to proceed in the said application

expeditiously and seek support from the judgments in the case of "Sakiri

Vasu Vs. State of U.P and others." and "M. Subramaniam and others Vs.

S. Janaki and others".

3. In light of the above, without commenting on the merits of the

case, the present petition stands dismissed as withdrawn, with liberty to the

petitioner to approach the competent authority under Section 156 (3)

Cr.P.C, who shall look into the same expeditiously.

4. It is made clear that the liberty granted if any is only on the

request of the counsel for the petitioner and is not a direction and the Court

shall proceed in accordance with law.
