On 21.07.2023, the following order was passed:-

"The prayer in the present petition under Section 482 Cr.P.C. is for quashing of the order dated 14.07.2022 (Annexure P-

6) and order dated 10.11.2022 (Annexure P-7) passed by the Chief Judicial Magistrate, Hisar whereby the proclamation proceedings under Section 82 Cr.P.C. were initiated against the petitioner and he was declared a proclaimed person and directions were issued to the SHO concerned to register an FIR under Section 174-A IPC alongwith warrants of attachment under Section 83 Cr.P.C. in complaint No.COMA-03-2017 dated 03.02.2017 (Annexure P-1) under Section 32 for violating Section 18(c), 18A, 22(3) punishment under Section 27(b) (ii), 28 and 22(3) of the Drugs and Cosmetics Act, 1940 and Rule framed there under.

The learned counsel for the petitioner contends that the proclamation was effected on the premises which already stood demolished. He further contends that even otherwise, the petitioner is ready and willing to join the proceedings and apply for concession of regular bail.

In the meanwhile, the petitioner is directed to surrender before the Trial Court within a period of two weeks from today and subject to a deposit of Rs.50,000/- as costs with the Association for Children with Type 1 Diabetes, SCO 24, Sector 23-C, Chandigarh, his prayer for regular bail be considered and decided within a period of two weeks thereafter.

The learned counsel for the petitioner shall produce the receipt regarding deposit of Rs.50,000/- with the aforesaid Institute on the next date of hearing."

Thereafter on 04.09.2023, the following order was passed:-

"The learned counsel for the State prays for more time to file a reply.

On his request, adjourned to 17.01.2024.

Let the reply on behalf of the respondent-State be filed well in time before the next date of hearing with a copy in advance to the counsel opposite."

The matter has come up for hearing today. None has put in

appearance on behalf of the petitioner.

Learned counsel for the State has referred to Para 11 of the

reply dated 28.08.2023 to content that the petitioner has not surrendered

before the Trial Court in terms of the order dated 21.07.2023.

In view of the above, the present petition stands dismissed.

All the pending miscellaneous applications, if any, stand

disposed of.
