1. Vide the present writ petition, the petitioner seeks a writ in the

nature of mandamus directing the respondents to release the gratuity and

other retiral benefits to the petitioner alongwith interest @18% from the date

till its becomes due and he further seeks direction to the respondents to

release regular pension to him instead of provisional pension as there is

nothing against him.

2. Learned counsel for the petitioner submits that except the

provisional pension and leave encashment other retiral benefits have not been

released to the petitioner, whereas it was released in case of similarly situated

persons who were involved in the same FIR after CWP-18927 of 2017 was

decided by this Court vide judgment dated 05.07.2019 (Annexure A-1). The

prayer of the petitioner is that a direction be given to the respondents to

decide his representation dated 11.08.2020 (Annexure P-4).

3. Learned State counsel has no objection to this limited prayer

made by learned counsel for the petitioner.

4. In view of the aforesaid and without commenting upon the

merits of the case, this petition is hereby disposed of with a direction to

respondents to decide the claim of the petitioner taking note of the judgment

passed by this Court on 05.07.2019 in CWP-18927 of 2017 and if found

entitled, necessary benefits be granted to the petitioner forthwith.

5. Pending applications, if any, also stand disposed of.
