Learned counsel for the appellant submits that the operation of

the judgment and decree of the Court below was stayed and nobody is

appearing on behalf of the respondent and it is not clear whether the

respondent-plaintiff is alive or not.

Learned counsel for the appellant further submits that the

present appeal may kindly be disposed of having been not pressed any

further with liberty to the appellant to revive the same in case any execution

petition is filed against the impugned judgment.

Ordered accordingly.

Any civil miscellaneous application pending if any, also stands

disposed of.
