Application for preponement of the date of hearing in the main

appeal, which is stated to be pending for 30.10.2023.

For the reasons mentioned in the application, the same is allowed

subject to all just exceptions. Main appeal is preponed and taken up on Board

today itself.

MAIN CASE

Applicant/appellant has filed the present appeal against the impugned

judgment dated 25.11.2019, passed by learned Principal Magistrate, Juvenile

Justice Board, Ludhiana, vide which, fine of Rs.500/- has been imposed upon

respondent No.2 for the commission of offence punishable under Section 181 of

the Motor Vehicle Act and he has been acquitted of the other charges.

(2) Learned Counsel for the applicant/appellant submits that in view of

the initial compromise dated 11.04.2023 and subsequent settlement dated

11.08.2023 (Annexures A-1 & A-2), respectively, entered into between the

parties, present appeal be disposed off as not pressed.

(3)          Ordered accordingly.

(4)          CRM-39436-2023 for withdrawal of the main appeal on the basis

of compromise is disposed off as having been rendered infructuous.

(5) Needless to say that passing of this order be not construed as an

expression of opinion regarding the genuineness of the aforesaid compromise,

entered into between the parties.

(6) Pending application(s), if any, shall also stand disposed off.
