1. Learned counsel for the petitioner submits that as the relief

claimed in this writ petition is gua a private non banking financial institution, he has instructions to withdraw this writ petition in view of judgment of Hon'ble Supreme Court in Phoenix ARC Private Limited vs. Vishwa Bharti Vidya Mandir and others, 2022 (1) RCR (Civil) 888 with liberty to the petitioner to avail the statutory remedy available to him in accordance with law.

2. Writ petition is accordingly dismissed as withdrawn with liberty as aforementioned.
