1. The petitioner through instant petition under Articles 226/227 of

the Constitution of India is seeking direction to respondent No. 2 to renew

his passport.

2. The petitioner was issued passport on 24.04.2009 which expired

on 23.04.2019. The petitioner vide application dated 05.06.2023 applied for

passport. Four FIRs came to be registered against the petitioner. The

petitioner was convicted vide judgment dated 17.11.2015 in FIR No. 194

dated 16.07.2010. The petitioner was acquitted in FIR No. 159 dated

28.04.2010 and he is facing trial in FIR Nos. 125 dated 23.04.2017 & 204

dated 04.10.2020.

3. The Centre Government in exercise of power conferred by

Section 22 of the Passport Act, 1976, has issued Notification No. 570 dated

25.08.1993 whereby it has been provided that despite pendency of criminal

trial, an applicant may be granted passport subject to permission by trial

court.

4. Faced with this, learned counsel for the petitioner seeks

permission to withdraw the instant petition with liberty to file an appropriate

application before trial court in terms of aforesaid Notification.

5. Dismissed as withdrawn with liberty as aforesaid.

6. If the petitioner moves an application before the trial court in

terms of the afore-stated Notification, the trial court would pass an

appropriate order expeditiously.
