1. The petitioner through instant petition under Article 226/227
of the Constitution of India is seeking direction to respondents No.1 and
2 to re-issue passport considering the fact that petitioner has already been
acquitted in the alleged criminal case.
2. Learned counsel for the petitioner inter alia contends that on
26.03.2012, the petitioner was issued passport which was valid up to
25.03.2022. The petitioner applied for re-issuance of passport, however,
respondent has not re-issued on the ground that police verification report
is not clear. An FIR No.60 dated 05.12.2015, under Sections 457, 380,
447, 294, 323, 506, 120B and 201 of IPC, was registered against the
petitioner. The petitioner was acquitted vide judgment dated 25.07.2019
passed by JMIC, Malerkotla. The complainant preferred an appeal before
Appellate Court which came to be withdrawn, thus, at present no case is
pending against the petitioner.

3. Mr. Arvind Seth, Advocate who on advance notice is present
in Court on behalf of respondents No.1 and 2 submits that petitioner may
be directed to appear before respondent No.2 alongwith all requisite
documents. The Passport Authority would redress grievance of the
petitioner.
4. In view of statement of learned counsel for respondents No.1
and 2, the present petition stands disposed of with a direction to petitioner
to appear before respondent No.2 on 20.07.2023 alongwith all requisite
documents. On doing so, respondent No.2 would pass an appropriate
order within a period of 4 weeks from 20.07.2023.
