This petition has been filed for grant of regular bail in FIR

No.51, dated 02.07.2022, registered at Police Station Kahnuwan, District

Gurdaspur, under Sections 379-B, 427, 411 & 34 IPC.

Learned counsel for the petitioner submits that petitioner has

undergone actual custody in excess of six months. The trial is not likely to

be concluded at an early date as no PW has been examined till now. There

is no other criminal case pending against the petitioner and thus, he may be

granted regular bail.

Custody certificate dated 23.01.2023 checked by Sh. Navinder

Singh, Jail Superintendent, Gurdaspur has been filed in Court. The same is

taken on record. A perusal thereof shows that the petitioner has undergone

actual custody of 06 months and 16 days and there are two other criminal

cases pending against him.

Learned counsel for the petitioner has submitted that the

custody certificate is erroneous. Judgments placed on record as Annexure

A-1 & A-2 clearly show that the petitioner has been acquitted in the cases

stated to be pending.

Learned State counsel concedes that examination of Pws has

not yet commenced.

It is thus evident that there is no other criminal case pending

against the petitioner. The trial is not likely to be concluded at an early

date, I deem it appropriate to grant him regular bail. Accordingly, the

petition is allowed. He is ordered to be released on bail on his furnishing

bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate

concerned.
