1. The present petition has been filed under Sections 12 & 14 of the
Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for punishing the respondent for not obeying the orders dated 17.06.2020 & 28.11.2023 (Annexures P-1 & P-2) passed by this court, whereby the respondent was restrained from carrying out any construction/demolition qua the common wall in question; along with certain other prayers.
2. Since the order, qua which the contempt is asserted, is an interim order passed in a revision petition, which is pending adjudication before the coordinate Bench of this court, therefore, it would be appropriate if the petitioner takes up his plea(s) regarding his claim, before the same Bench, where the aforesaid petition is pending.
3. In view of the above, the present petition is dismissed. However, the petitioner would be at liberty to make appropriate prayer before the
concerned Bench before which the revision petition is listed for hearing.
