1. The present petition has been filed by the petitioner under Section 12 of the Contempt of Courts Act, 1971 for initiating contempt proceedings against the respondent for not complying with the order dated 08.05.2023 (Annexure P-1) passed by this court in RSA No.1353 of 2023.

2. The order, qua which the contempt is alleged, is of the nature qua which determination of contempt would require adjudication of several disputed questions of fact. However, contempt proceedings are not to be used to adjudicate upon the disputed questions of facts between the parties. Hence, this court does not find it appropriate to initiate any contempt proceedings in the matter. Accordingly, the present petition is dismissed.

3. However, the petitioner would be at liberty to avail any other

alternate remedy, but in accordance with law.
