1. The petitioner through instant petition under Articles 226/227 of

Constitution of India is seeking directions to respondents to issue his

passport.

2. Learned counsel for the petitioner inter alia contends that

petitioner vide application dated 20.1.2022 applied for passport and

respondents on account of pendency of criminal case has declined

application of the petitioner. The petitioner was convicted by

Additional District Judge, Kaithal and petitioner preferred CRA-S-121-

SB of 2008. Sentence of the petitioner was suspended vide order dated

3.3.2008 passed by this Court. Case of the petitioner is squarely covered

by judgment of this Court in Mohan Lal @ Mohna vs. Union of India

and others, CWP No. 27167 of 2018.

3. On being confronted with the aforesaid judgment, Mr. Arvind

Seth, counsel for Union of India submits that application of the

petitioner has already been closed and he may file fresh application

which the respondents would decide in view of observations of this

Court in Mohan Lal @ Mohna (supra).

4. The instant petition stands disposed of with liberty to the

petitioner to file a fresh application which respondents would decide

after considering judgment of this Court in Mohan Lal @ Mohna

(supra).
