By a detailed judgment dated 28.03.2023, this Court, after

thoroughly examining the facts, which had come on record, has found that

the parties deserve to be relegated to the alternative remedy.

Undoubtedly, vide various interim orders, the question, which arose for

consideration was culled out, however, in the facts of the case, it was not

considered appropriate to finally answer the aforesaid question. Once

again the matter has been heard at length in the review application. After

having analyzed the submissions of the learned senior counsel

representing the review applicant, the review application is required to be

disposed of with the following two clarifications:-

i) Needless to observe that once the parties have been

relegated to the alternative remedy, the observation, if any, made by the

court on merits of the case, shall not be binding between the parties and

the competent court shall be at liberty to decide the case independently.

ii) In the last sentence of para 12 of the judgment, the

expression "The petitioner" shall be construed as "The parties to the

litigation".

With the aforesaid observations, disposed of.

All the pending miscellaneous applications, if any, are also

disposed of.
