By way of filing the present revision petition, petitioner Navreet

Kaur is impugning order dated 14.3.2023 passed by Civil Judge, Junior

Division, Sultanpur Lodhi vide which an application moved by the petitioner

who is defendant No. 3 in the civil suit for seeking direction to produce PW5

Jasbir Singh for cross-examination had been dismissed. It may be mentioned

here that earlier the plaintiffs feeling aggrieved by order dated 10.10.2022

vide which evidence of plaintiff had been closed by order had filed a

revision petition bearing CR No. 5171 of 2022 before this Court. It was

allowed vide order dated 20.12.2022 vide which the order closing evidence

of plaintiff was set aside and plaintiffs were given one opportunity to

conclude their remaining evidence including causing appearance of PW5

Jasbir Singh for cross-examination subject to payment of Rs.10,000/- as

costs. Admittedly that order has not been complied with by the plaintiffs.

Now they have thought of a clever plan to by-pass the order by getting an

application moved from defendant No. 3 Navreet Kaur, who is none else but PARVINDER SINGH 2023.04.25 09:10 I attest to the accuracy and integrity of this order/judgment Chandigarh CR No. 2396 of 2023 2 2023:PHHC:057479

daughter of plaintiff Harjinder Singh and sister of plaintiff Ravdeep Singh

who is a proforma defendant having common interest with the plaintiffs. The

trial Court has passed a detailed order declining the application. The order

does not suffer from any illegality or infirmity and does not call for any

interference.

The revision petition is dismissed accordingly.
